There are many reasons why payments get delayed that often have nothing to do with you ranging from problems with the loan to the insolvency of the property owner or General Contractor. When this happens, payments will be made to the subcontractors with the highest priority, those with lien rights. Exercising your lien rights has an immediate effect on those that manage the project funding.

If you furnish labor or materials according to contract, you have a contractual relationship with whoever hired you and no one else. If you are not paid for any reason, the law allows you to only sue the parties in your contract. If you were hired by a subcontractor, you may not sue the General Contractor, the Owner or pursue the Bonding Company. Exercising your lien rights changes this. You are no longer limited to the subcontractor, but you may also sue the Prime or General Contractor and the Owner for amounts owed you and you may go after the bond in the event the project is protected by one.

Exercising your lien rights often freezes project funds. Many states require that construction funds be frozen to ensure that money due you is not used elsewhere. This makes the parties holding or managing the funding liable for your debt. When a lien is placed on real property, the owner withholds funds amounting to the value of the lien. This is done because no one wants to be stuck with the debt. Freezing the funds stops the cash flow, substantially increasing your chances of being paid.

Secure Your Receivables.

The property becomes your collateral against your debt and the property becomes your security. Those that exercise their lien rights attach the underlying property on a construction project, giving you a security interest in the property itself in the event your debt goes unpaid. If you are not paid and have lien rights, you could in theory own a portion of the property equal to the amount owed you. You can foreclose on the property the same way a bank does, demand that the sheriff sell the property and pay you what is owed.
